These Terms are a binding agreement between you and Zachary Smet, the Wisconsin-based operator of Threvu (collectively, “Threvu,” “we,” or “us”). They apply to organizers, venue subscribers, guests, and anyone who accesses the service. By creating an account, buying or activating an event, affirmatively joining as a participant, or posting content, you accept the Terms that apply to that action. Passive feed viewing does not record an acceptance.
1. What Threvu provides
Threvu provides private event links and QR codes, guest photo uploads, feeds, likes, comments, organizer moderation, live venue displays, post-event albums, and organizer downloads. Each participant may upload no more than three photos per event. “Private” means access is limited by an event-specific link and organizer controls; it does not mean that every attendee shown in a photo has approved it or that a link cannot be forwarded.
2. Eligibility and accounts
- Organizers and venue-plan owners must be at least 18 and able to enter a binding contract.
- Guests must be at least 18, or at least 13 with permission from a parent or legal guardian.
- Threvu is not offered to children under 13. A person under 13 may not independently access or use Threvu. An adult may choose to show a child an adult-controlled event display, but the child must not operate the service, receive a guest session, set a nickname, upload, comment, like, or provide an email.
- You must provide accurate account information, protect your login and event links, and promptly report suspected unauthorized access.
- One person or organization may not create accounts to evade event, upload, moderation, safety, or billing limits.
3. Organizer responsibilities
Organizers control the event and are responsible for:
- having authority to host the event and use the venue, screens, network, and event name;
- giving attendees reasonable notice that photos may be uploaded, shared with event participants, and shown on venue screens;
- obtaining any consent required by law, contract, venue policy, employment policy, or the circumstances, especially for minors, private locations, employees, and sensitive events;
- keeping the event link and organizer controls reasonably secure and distributing access only to intended participants;
- choosing and supervising moderation, promptly using hide, reject, safe-screen, or blackout controls when needed, and reviewing removal reports;
- testing the venue internet connection and display before the event; and
- downloading desired content before the retention period ends.
Threvu does not replace a photographer, security staff, legal consent process, content moderator, or a venue’s safety procedures.
4. Guest responsibilities
When you post, comment, or react, you direct Threvu to make that content available to the organizer, people with event access, and—if approved—the live display and private album. You must follow the Acceptable Use Policy. Do not assume the organizer or Threvu has permission for content you supply; that responsibility remains yours.
5. Your content and the operating license
You keep ownership of photos, comments, event names, and other content you supply. You grant Threvu a non-exclusive, worldwide, royalty-free license to host, copy, convert, resize, transmit, display, moderate, remove, and otherwise process that content only as reasonably necessary to operate, secure, troubleshoot, support, and legally protect the event, display, album, and service. You also instruct us to make event content available to the organizer and intended event participants.
This license ends when the content is deleted from active systems, except for limited encrypted backups, legal holds, security evidence, and records we must retain. Threvu receives no right to use private event content in advertising, public portfolios, model training, or social media without a separate, specific opt-in from the rights holder. There is no implied marketing release.
You represent that you created the content or have the rights needed to submit it; that your submission and the uses described above do not violate copyright, privacy, publicity, contractual, or other rights; and that you have any permission required from identifiable people. A person shown in content may submit a removal request even if they were not the uploader.
6. Moderation, reports, and removal
Organizers may approve, hide, reject, restore, or remove event content. Threvu may remove content, limit display, preserve evidence, restrict an event, or suspend an account when reasonably necessary to enforce these Terms, respond to a credible rights or safety report, comply with law, protect people or the service, or investigate abuse. Moderation is not a promise that every item will be reviewed before display. Use the support form for urgent safety, copyright, privacy, or removal reports and include the event or photo reference.
7. One-time event purchases
A one-time purchase activates one event at the selected participant limit. Current tiers and exact prices appear on the Pricing page and again before checkout. The three-photo rule applies to every tier. Unused participant or upload capacity has no cash value, cannot be transferred to another customer, and does not roll into another event. Taxes, if any, are shown by the payment processor before payment. The Refund and Cancellation Policy is part of these Terms.
8. Threvu for Venues
Threvu for Venues is $99.00 USD per month. It automatically renews each month until canceled and includes up to 12 qualifying events during each Stripe billing period, with up to 150 participants per covered event. There is no metered overage and no claim of unlimited use. When the allowance is exhausted or an event exceeds 150 participants, the organizer may use the one-time event flow or contact support.
The exact price, renewal frequency, limits, cancellation method, and refund terms are disclosed immediately before consent and again at Stripe Checkout. Venue subscribers may cancel online through Manage billing. Cancellation is scheduled for the end of the current paid period unless law or Stripe requires a different result. Canceling or later losing entitlement does not terminate an event already validly activated, delete a completed album, or retroactively convert a covered event into a one-time charge. It prevents new covered activations after entitlement ends.
We keep a versioned record of the renewal terms affirmatively accepted. Material price or renewal changes will be disclosed before they take effect, with a usable cancellation method. Annual billing and automatic overage charges are not offered.
9. Payments and billing
Stripe processes payment details. Threvu does not receive or store a full card number or card security code. You authorize Stripe and Threvu to charge the displayed amount and applicable taxes. You are responsible for accurate billing information and authorized use of the payment method. We may suspend new paid activations for failed, reversed, disputed, fraudulent, or unauthorized payments while preserving rights that already vested under these Terms.
10. Privacy and retention
The Privacy Notice explains what is collected, who receives it, retention, security, and available rights. Event content is temporary service data, not permanent archival storage. Organizers should keep their own download. A storage or download failure does not transfer ownership to Threvu or create a duty to keep content indefinitely.
11. Threvu intellectual property
Threvu and its licensors own the service software, visual design, trademarks, documentation, and non-user content. These Terms give you a limited, revocable, non-transferable right to use the service for its intended event purpose. They do not permit copying, reselling, reverse engineering except where law forbids restriction, automated scraping, removal of notices, or use of Threvu branding in a way that suggests endorsement.
12. Service changes and availability
We may improve, replace, or discontinue features. We will not intentionally remove a material paid entitlement during its active event without a reasonable substitute, refund, or credit where appropriate. Internet, browser, device, display, venue-network, third-party-provider, and force-majeure failures can affect service. No uptime, uninterrupted display, or permanent storage guarantee is made unless a separate signed agreement says otherwise.
13. Disclaimers
To the maximum extent permitted by law, Threvu is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, title, and non-infringement. We do not warrant that content is accurate, lawful, consented to, appropriate, available, or free of material a viewer may find objectionable. These disclaimers do not exclude any warranty or remedy that cannot lawfully be excluded.
14. Liability limits
To the maximum extent permitted by law, Threvu and the operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, goodwill, data, or opportunity; or claims arising from user content, attendee conduct, forwarded event links, venue conditions, or third-party services. Threvu’s total aggregate liability arising from the service will not exceed the greater of $100 USD or the amount you paid Threvu during the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot be limited, including liability for intentional misconduct, fraud, or other non-waivable obligations under applicable law.
15. Indemnity
If you are an organizer, venue subscriber, or business user, you will defend and indemnify Threvu and the operator from third-party claims, losses, and reasonable costs arising from your event, your content, your instructions, your failure to obtain required permission or notice, your breach of these Terms, or your violation of another person’s rights. This duty does not cover a claim caused by Threvu’s own intentional misconduct or breach. Consumer guests are responsible for their own violations but are not required to indemnify Threvu where applicable law prohibits it.
16. Suspension and termination
You may stop using Threvu, request account deletion, or cancel a venue subscription. We may suspend or terminate access for material or repeated violations, unlawful or dangerous conduct, security threats, nonpayment, chargeback abuse, or legal requirements. When practical and safe, we will give notice and a chance to cure or appeal. Provisions about payment, content rights already exercised, retained records, disclaimers, liability, indemnity, and disputes survive termination as necessary to give them effect.
17. Changes to these Terms
We may update these Terms prospectively. The version and effective date appear above. Material changes will be communicated through the service or the organizer email when reasonably available. Changes do not retroactively alter a completed purchase or resolved claim. Continued use after the stated effective date accepts the revised Terms; if you disagree, stop using the service and cancel before the next renewal.
18. Governing law and disputes
Wisconsin law governs these Terms without regard to conflict-of-law rules. Claims may be brought in a state or federal court with jurisdiction where the operator resides, and the parties consent to that venue. This section does not deprive a consumer of mandatory protections or a forum that applicable law makes non-waivable. Before filing a claim, please send a detailed legal or billing notice and allow 30 days for a good-faith attempt to resolve it, unless delay would prejudice a legal right or emergency relief is needed.
19. General terms
These Terms, the incorporated policies, checkout disclosures, and any signed order are the complete agreement for the service. A signed order controls only where it expressly conflicts. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be narrowed to the lawful minimum and the rest remains effective. You may not assign the agreement without consent; Threvu may assign it as part of a bona fide business transfer if the successor assumes these obligations. Headings are for convenience. “Including” means “including without limitation.”
20. Contact and notices
Threvu is the public business name used by Zachary Smet in Wisconsin. Submit service, billing, legal, safety, copyright, or removal notices through the secure contact form. Privacy requests use the privacy request form. Each accepted request returns a reference you can retain. Do not submit passwords, full card numbers, card security codes, or unnecessary sensitive information.
